Your Rights to Buy a Medigap Policy

Eligibility

Open Enrollment Period – coverage is available to you regardless of age, health status or medical conditions when:

  • You are applying within 6 calendar months beginning with the month of your 65th birthday.
  • You are applying within six calendar months immediately following the month you enroll in Medicare Part B.

Guaranteed issue rights – in some situations, if your other health coverage terminates, you have the right to enroll in a Medicare supplement or Medicare select policy like 65Plus regardless of your health status. You are automatically accepted for coverage, and no health questions are required to be answered if:

  • Your Medicare Advantage or Medicare cost plan stops participating in Medicare or providing care in your service area; or
  • You move outside a health plan’s geographic service area; or
  • You leave a health plan because it failed to meet its contract obligations to you; or
  • Your employer group health plan ends some or all of your coverage; or
  • Your Medicare supplement insurance company ends your Medigap or Medicare select policy and you’re not at fault (for example, the company goes bankrupt); or
  • You drop your Medigap policy to join a Medicare Advantage plan, a Medicare cost plan, or buy a Medicare select policy for the first time and then leave the plan or policy within one year after joining (however, you may only return to the Medigap policy under which you were originally covered, if available); or
  • You drop your Medicare Prescription Drug (Part D) plan.
  • You join a Medicare Advantage plan or a Medicare cost plan and within one year of joining, you decide to leave the health plan; or
  • You have Medicare Parts A and B and are covered under, Medicaid and lose eligibility under Medicaid.

When you meet any of the above conditions and you apply for your new Medigap policy no later than 63 calendar days after your health plan or policy ends, the Medigap insurance company can not deny you insurance coverage.
